Irish privacy regulator starts new investigation into transfer of personal data by TikTok to China

Ireland's privacy regulator (the Data Protection Commission, DPC) is launching a new investigation into TikTok's transfer of European users' personal data to China. 

On May 2, 2025, the DPC fined TikTok €530 million for violating the General Data Protection Regulation (learn more). During that investigation, TikTok stated that it did not store EU users' personal data in China. In April 2025, TikTok admitted that it did in February 2025. Following consultations with other European privacy regulators, the DPC is now launching a new investigation. Transfers to China are subject to strict requirements under the AVG to protect the privacy of TikTok users.

TBYP claims in the Dutch proceedings, among other things, that TikTok must stop the unlawful transfer of children's personal data to China. By opening a new investigation, the DPC shows that it, too, considers the transfer of personal data to China to be of concern.
